1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and HotJupiter ("we", "us", or "our"), a website building service operating in the Republic of South Africa.

By accessing our website, using our services, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

2. Service Description

HotJupiter provides the following website building services:

  • AI-Powered Website Creation: Instant generation of professional business websites using artificial intelligence technology
  • Logo Design: AI-generated logo designs with multiple options to choose from
  • Web Hosting: Secure hosting of your website on our infrastructure for the specified period
  • Domain Registration: Registration of a .co.za domain name on your behalf (where applicable)
  • SSL Certificate: Provision of HTTPS security for your website
  • Support: Customer support via WhatsApp during business hours

3. Payment Terms

  • Website Package Price: R699 (six hundred and ninety-nine South African Rand) as a once-off payment
  • What's Included: The R699 payment includes website creation, AI-generated logo, 12 months of hosting, and a .co.za domain registration
  • Payment Method: All payments are processed securely through Yoco, a PCI-DSS compliant payment provider registered in South Africa
  • Currency: All prices are quoted and payable in South African Rand (ZAR)
  • VAT: Prices are inclusive of Value Added Tax (VAT) where applicable
  • Renewal Fees: After the initial 12-month period, hosting and domain renewal is R149 per year, payable in advance
  • Payment Confirmation: You will receive a payment confirmation via WhatsApp and/or email upon successful payment
  • Failed Payments: If a payment fails, we will notify you and no services will be rendered until payment is successfully processed

4. Intellectual Property Rights

The following intellectual property provisions apply:

  • Your Content: You retain full ownership of all business information, photographs, text, and other content you provide to us for use in your website
  • Generated Content: Upon full payment, you are granted a perpetual, non-exclusive licence to use the AI-generated logos, website designs, and content created for your website
  • Our Platform: All technology, software, code, systems, and processes used by HotJupiter remain our exclusive intellectual property
  • Third-Party Content: Stock images and other third-party content used in your website are licensed in accordance with their respective licences
  • Restrictions: You may not resell, redistribute, or sublicense the website templates, code, or design systems used to create your website
  • Copyright Notice: We reserve the right to include a small "Powered by HotJupiter" credit on your website footer

5. Privacy and Data Protection (POPIA Compliance)

We are committed to protecting your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

  • Information We Collect: Business name, contact details (name, email, phone number), business description, location, and payment information
  • Purpose of Collection: Your information is collected solely for the purpose of providing our website building services, communicating with you, and processing payments
  • Lawful Processing: We process your personal information based on your consent and the contractual necessity to provide our services
  • Data Security: We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, loss, or destruction
  • Third-Party Sharing: We may share your information with trusted service providers (Yoco for payments, Vercel for hosting, domain registrars) solely for the purpose of delivering our services
  • Data Retention: We retain your personal information for as long as your website is active, plus 5 years thereafter for legal and tax purposes
  • Your Rights: Under POPIA, you have the right to access, correct, or delete your personal information, and to object to processing. Contact us to exercise these rights

  • Complaints: You have the right to lodge a complaint with the Information Regulator of South Africa

6. Limitation of Liability

To the maximum extent permitted by South African law, including the Consumer Protection Act:

  • Service Provided "As Is": Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
  • No Guarantee of Results: We do not guarantee any specific business results, traffic, or revenue from your website
  • Indirect Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data
  • Maximum Liability: Our total aggregate liability arising from or relating to these Terms or our services shall not exceed the amount you paid to us (R699)
  • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions
  • Third-Party Services: We are not liable for any issues arising from third-party services including payment processors, hosting providers, or domain registrars
  • Your Responsibility: You are solely responsible for the accuracy and legality of the content you provide for your website

7. Cancellation and Refund Policy

  • Cooling-Off Period: In accordance with the Consumer Protection Act, you have the right to cancel within 5 business days of purchase for a full refund, provided that no website has been delivered
  • Pre-Delivery Cancellation: If you cancel before we have delivered your website, you are entitled to a full refund of R699
  • Post-Delivery: Once your website has been delivered and you have approved it, no refunds will be provided as the service has been rendered
  • 24-Hour Guarantee: If we are unable to deliver your website within 24 hours of receiving all required information from you, you are entitled to a full refund
  • Dissatisfaction: If you are not satisfied with your website, we will work with you to make reasonable changes (up to 3 revisions). If we cannot reach a satisfactory outcome, a partial refund may be considered at our discretion
  • Refund Processing: Approved refunds will be processed within 7-10 business days to the original payment method
  • Cancellation by Us: We reserve the right to cancel your service and issue a full refund if we determine that your requested website content violates our acceptable use policy
  • Hosting Renewal: Hosting renewal payments (R149/year) are non-refundable once the renewal period has commenced

8. Website Delivery and Acceptance

  • Delivery Timeline: We aim to deliver your website within 100 seconds of receiving your information, but delivery may take up to 24 hours in complex cases
  • Preview: You will receive a preview link to review your website before it goes live
  • Revisions: You are entitled to 3 free revisions during the initial creation process
  • Acceptance: By confirming your satisfaction or failing to request changes within 7 days, you are deemed to have accepted the website
  • Post-Launch Edits: Minor text changes are available free of charge for 7 days after launch. Substantial changes may incur additional fees

9. Acceptable Use Policy

You agree not to use our services to create websites containing:

  • Illegal goods, services, or activities under South African law
  • Adult, pornographic, or sexually explicit content
  • Hate speech, discrimination, or content promoting violence
  • Scams, fraud, phishing, or misleading business practices
  • Copyright-infringing or plagiarised material
  • Malware, viruses, or harmful code
  • Defamatory content or content violating the privacy of others
  • Impersonation of other businesses or individuals

We reserve the right to refuse service, terminate websites, or remove content that violates this policy without refund.

10. Hosting Terms

  • Hosting Period: Your initial R699 payment includes 12 months of hosting from the date of website delivery
  • Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service availability
  • Fair Usage: Hosting is subject to fair usage limits suitable for small business websites. Excessive bandwidth usage may require an upgrade
  • Renewal Notice: We will notify you at least 30 days before your hosting period expires
  • Non-Renewal: If you do not renew hosting, your website will be taken offline. Content will be retained for 30 days, after which it may be permanently deleted

11. Domain Name Terms

  • Domain Registration: We register your .co.za domain through accredited South African domain registrars
  • Domain Ownership: The domain is registered on your behalf and you are the legal owner, subject to the registrar's terms
  • Domain Transfer: Upon request, we can transfer the domain to another registrar, subject to applicable transfer fees and procedures
  • Domain Disputes: Domain name disputes are handled in accordance with the South African domain registry's dispute resolution policies

12. Termination

  • Termination by You: You may request termination of your website at any time by contacting us. No refund will be provided for unused hosting time
  • Termination by Us: We may terminate your website immediately if you breach these Terms, particularly the Acceptable Use Policy
  • Effect of Termination: Upon termination, your website will be taken offline and your content will be deleted after 30 days
  • Data Export: You may request a copy of your website content before termination

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of South Africa
  • Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa
  • Consumer Rights: Nothing in these Terms shall limit or exclude any rights you may have under the Consumer Protection Act 68 of 2008
  • Alternative Dispute Resolution: Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good faith negotiation
  • National Consumer Commission: You may lodge a complaint with the National Consumer Commission if you believe your consumer rights have been violated

14. Indemnification

You agree to indemnify, defend, and hold harmless HotJupiter, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your breach of these Terms; (c) any content you provide for your website; or (d) your violation of any rights of third parties.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and HotJupiter regarding our services
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction
  • Notices: We will communicate with you via WhatsApp, email, or through our website. You can contact us via the methods listed below

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or WhatsApp at least 14 days before they take effect. Your continued use of our services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
